Najib files bid to quash suit filed by Dr M, two others

Prime Minister Najib Abdul Razak has filed an application to strike out the suit filed by Dr Mahathir Mohamad and two others on the grounds that there were no elements of tort misfeasance as claimed by the three plaintiffs.

Lawyer Wan Azmir Wan Majid, representing Najib, said the suit filed by Mahathir, former Batu Kawan Umno division chief Khairuddin Abu Hassan and former Langkawi Wanita Umno member Anina Saadudin as plaintiffs was frivolous and vexatious.

“The prime minister filed an application to strike out the suit yesterday on the grounds that there were no tort misfeasance elements as stated in the plaintiffs’ writ of summons and statement of claim,” he said.

He said the application would be heard on June 23 before High Court Judge Rosnaini Saub.

Wan Azmir was speaking to reporters after case management before Senior Assistant Registrar Erry Shahriman Nor Aripin today.

Also present was counsel Mohamed Haniff Khatri Abdulla, representing the three plaintiffs.

Mohamed Haniff Khatri said the court had also ordered the prime minister to file a statement of defence before or on April 28.

On March 23, Dr Mahathir, 90, Khairuddin, 54, and Anina, 41, filed the suit naming Najib as the defendant.

They cited alleged misconduct on the part of the prime minister involving strategic development fund 1Malaysia Development Berhad (1MDB).
