Former DSP jailed 12 years, fined RM105,000 for bribery

A former deputy superintendent of police (DSP) was sentenced to a total of 12 years’ jail by the Sessions Court in Shah Alam today after he was found guilty on three counts of soliciting bribes, totalling RM21,000 a few years ago.

Nik Azainoon Nik Aziz, 54, who was with the Bukit Aman Commercial Criminal Investigation Department when the offences were committed, however, would only have to serve four years in jail, as the court ordered the jail sentences to be served concurrently from today.

Judge Asmadi Husin also fined him a total of RM105,000, in default 15 months jail, for the offence.

Nik Azainoon’s friend, Roslan Jali, 49, was sentenced to a total of eight years’ jail and fined RM55,000, in default seven months’ jail, for abetting him.

However, he only had to serve four years’ in jail as the court ordered the jail sentences for the two counts to be served concurrently from today.

Roslan, an electrician, was found guilty on two counts of agreeing to accept a bribe of RM11,000 on behalf of Nik Azainoon.

In mitigation, Nik Azainoon and Roslan, both unrepresented, said they had families to support.

Asmadi allowed a stay of the jail sentence pending their appeal and raised the bail for Nik Azainoon and Roslan from RM10,000 and RM7,000, respectively, to RM50,000 each.

They are, however, given until tomorrow to pay the fine and to report themselves at the Shah Alam branch of the Malaysian Anti-Corruption Commission (MACC) office on the first week of every month.

Nik Azainoon was found guilty of soliciting bribe from a Tenaga Nasional Berhad employee, Che Ayub Senik, 61, as an inducement to erase his (Che Ayub) record for alleged involvement in ‘Black Money’ activities.

The former police officer was alleged to have solicited the bribe twice, for RM10,000 and RM4,000, at Restoran Starwalk Cafe & Bakery, Jalan Dagang B/3A, Taman Dagang, Ampang, between Nov 5 and 30, 2008.

He was also charged with conspiring with Roslan to solicit bribe of RM7,000 from Che Ayub for the same purpose at the A&W Restaurant, Lorong Sultan, Petaling Jaya at about 6.10pm on Feb 4, 2009.

Roslan was charged with agreeing to accept RM4,000 on behalf of Nik Azainoon for the same purpose at Restoran Starwalk Cafe & Bakery, Jalan Dagang B/3A, Taman Dagang, Ampang, between Nov 6 and 30, 2008.

On the second count, Roslan was charged with committing the offence by agreeing to accept RM7,000 for the same purpose on behalf of Nik Azainoon on Feb 4, 2009, at the A&W Restaurant, Lorong Sultan, Petaling Jaya.

The prosecution was conducted by prosecuting officer from MACC Mohd Sukri Seman.
