Selangor Menteri Besar Azmin Ali's application for leave to challenge the classification of the auditor-general's report on 1MDB under the Official Secrets Act 1972 will be heard on Oct 26.

High Court deputy registrar Norazlin Othman fixed the date when the matter came up for case management today.

Azmin's lawyer Michelle Sunita Kummar of Tommy Thomas & Co told reporters that the hearing will be held before judge Hanipah Farikullah in the High Court in Kuala Lumpur.

The PKR deputy president filed the judicial review application last month, naming Prime Minister Najib Abdul Razak, auditor-general Ambrin Buang and the government as the first, second and third respondents.

The application seeks a declaration that classifying the report under OSA is unlawful and ultra vires (beyond the powers) of the Federal Constitution.

He is also seeking a mandamus to compel the three respondents, their agents and officers to declassify the 1MDB report pursuant to Section 2C of the OSA, and for it to be released to the public.

Judicial review applications require leave (permission) to be granted first, to ensure the application is not frivolous or vexatious.

This is the second challenge on the final report of the auditor-general on the 1MDB report, after the earlier challenge filed by Malacca Umno member Muhammad Zahid Arip.

Muhammad Zahid's application is fixed for hearing on Nov 10.
