DAP will file a motion to review Dewan Rakyat speaker Pandikar Amin Mulia's ruling that ministers need not answer questions on the United States Department of Justice lawsuit, to avoid sub judice.

DAP's Gelang Patah MP Lim Kit Siang said the motion will be filed under Standing Order 43 once yesterday's Hansard is released.

"Yesterday we asked the speaker when we can do so (debate the motion) and he kept quiet. So we will wait for yesterday's Hansard before we file the motion," he told reporters at the Parliament lobby.

Pandikar yesterday said ministers need not respond to MPs' questions on the DOJ civil forfeiture suit filed in the California District Court in July.

The DOJ seeks to seize more than US$1 billion of assets it believes were purchased using funds allegedly siphoned from 1MDB.

Pandikar's decision was questioned by former Court of Appeal judge Mohd Hishamudin Mohd Yunus who said the issue of sub judice does not arise because the DOJ case is filed in a foreign jurisdiction.

He said the sub judice argument only applies if the case is heard in a Malaysian court.

Sub judice is a latin term meaning "under judgment", which means that a particular case or matter is under trial or being considered by a judge or court.
