Haniff Khatri, a lawyer to former prime minister Dr Mahathir Mohamad, has accused Dewan Rakyat speaker Pandikar Amin Mulia of inciting police reports against former ministers.

Haniff noted that former ministers Muhyiddin Yassin, Mohd Shafie Apdal and Ahmad Husni Hanadzlah faced several police reports after Pandikar publicly claimed they may have breached their oaths of secrecy.

This was over their speeches in Parliament criticising the government's handling of the 1MDB scandal.

"The Parliament speaker, through his statement, provided legally erroneous understanding that the three MPs' speeches supposedly breached their oaths of secrecy, more specifically the Sedition Act and Official Secrets Act (OSA)," said Haniff.

MPs are accorded protection for their statements in Parliament but this does not include breaches of the Sedition Act and OSA.

Muhyiddin, Shafie and Husni serve the parliamentary constituencies of Pagoh, Semporna and Tambun respectively.

Pandikar did not specify what part of the trio's speeches were in breach of the law but several police reports had since been lodged against the trio after his statement.

Inspector-general of police Khalid Abu Bakar had also said that cops would call up the three to have their statements recorded.

Haniff said that as Pandikar made his statement outside of Parliament, he did not enjoy parliamentary protection.

He claimed Pandikar's statement of inciting police reports against the MPs was "an act detrimental to parliamentary democracy".

"This is because he tried to prevent MPs from carrying out their duties in debating and discussing relevant issues in Parliament, in accordance with the Federal Constitution."

As such, Haniff claimed that it was Pandikar, Khalid as well as the NGOs who have lodged police reports against the former ministers, who were in the wrong.
