Wanita MCA has rebuked Bukit Gelugor MP Ramkarpal Singh for dismissing its proposal to charge serial rapist Selva Kumar Subbiah a second time for the offences he was convicted of in Canada.

Its chief Heng Siai Kie in a statement said it was regrettable that the DAP MP had defended Selva and instead diverted Wanita MCA's intention to safeguard would-be victims irrespective of gender as contravening the Federal Constitution.

"If Wanita MCA’s urgings are seen as ultra vires to the Federal Constitution, then DAP must similarly Rocket to blitz Wanita PKR chairperson Zuraida Kamaruddin as likewise breaching the Federal Constitution...," said Heng who cited Zuraida's proposal last night for Subbiah to be arrested upon arrival from Canada where he had served a 24-year prison sentence.

Heng had first made the suggestion last Friday, in intensifying calls for the government to enact a sex offenders registry, a mechanism which she said has been introduced under amendments passed to the Child Act 2001.

She also said that Malaysia should have double jeopardy laws in place for overseas sex offenders to face fresh charges on home soil.

"I urge YB Ramkarpal to read our Wanita MCA press statement in full.

"He missed our point that laws should be enacted so that Malaysians who have committed sex offences overseas, must face charges and convictions back home," she said.

Ramkarpal, in response to Heng's double jeopardy proposal, had said the suggestion was unconstitutional as Article 7(2) of the Federal Constitution states that a person acquitted or convicted of an offence cannot be tried again for the same offence unless the conviction or acquittal was quashed or a retrial is ordered.

Heng, however, pointed out that DAP's Kota Damansara state-assemblyperson Yeo Bee Yin had also made a similar proposal for Selva to be placed under the sex offenders registry, aside from outrage from netizens over news that Selva will be a free man in Malaysia.

"Majority of netizens have responded with outrage that Selva will be a free man without any restrictions to his movements in Malaysia.

"By the same logic of attacking Wanita MCA, but not Wanita PKR or DAP’s Yeo Bee Yin, DAP should thus admonish all the majority of Malaysian netizens as violating the Federal Constitution," said Heng who also questioned the perceived silence from other Pakatan Harapan's women component party leaders.

Commenting further, Heng said that Wanita MCA's stand is neither unprecedented nor uncalled for, as it has also been practiced by other countries.

"The rights and interest of public safety especially vulnerable and helpless groups such as children must be superior over the sex fiend," she said.

Canadian newspaper Toronto Star first reported on Feb 1 that Selva, who was suspected of assaulting as many as 1,000 women, would be deported yesterday following the completion of his prison term.

The 56-year-old was denied parole in 2014 as he was deemed to be a person with a high risk to reoffend.
