The Shah Alam High Court today fixed March 24 as a new date to hear the bail application for a 15-year-old Rohingya refugee who has been detained for over three months.

High Court judge Ghazali Cha made the decision after hearing submissions from DPP Mahathir Khairuddin and lawyer Collin Arvind Andrew who represented the teenager's family.

Collin told the court that the defence is ready for the hearing today but Mahathir requested for a two-week postponement.

This was to allow them time to respond to affidavits submitted by the defence, said Mahathir.

"We just received the (bail) application yesterday and it included supporting affidavits.

"I am requesting for a new hearing date and in the time I will prepare the responses which I feel is necessary," said Mahathir.

Among others, Mahathir said the prosecution will be seeking clarifications from the investigating officer in charge, over the teenager's asylum status as well as on an appended report from a psychology expert.

Collin, however, argued that further prolonged detention would have a negative impact on the teenager's mental state.

He also said the defence had submitted that the teenager can be released into the custody of Yayasan Chowkit - a shelter home for children.

The 15-year-old was charged under Section 6(1) of the Immigration Act for not having any valid travel documents in the vicinity of the Dato' Abu Bakar Baginda police station in Sepang district on Dec 11 last year.

The Sepang Magistrate's Court on Feb 28, had denied the teenager's application for bail.

The defence then filed an application at the Shah Alam High Court, that the boy's detention since Dec 11 be set aside, quashed or stayed as it was in contravention of the Child Act 2001 and Article 22 of Child Rights Convention, which protects refugees seeking asylum from being prosecuted.
