The Shah Alam High Court today granted bail to the 15-year-old Rohingya refugee who had been detained for over three months.
"The High Court judge allowed bail with the condition that he is placed under the care of Yayasan Chow Kit until the case ends," the teen's family lawyer Collin Arvind Andrew told Malaysiakini today.
Bail was set at RM2,000, with a Malaysian as guarantor.
Collin also said that the teenager was placed with Yayasan Chow Kit, a shelter home for children, to ensure his welfare is taken care of.
Yayasan Chow Kit also has to arrange for the teenager's transportation to and from the court every time he is required to be there, he added.
Collin said they wanted to show that this is an alternative to being detained in prison as they had a psychologist report that showed prolonged detention is not good for the Rohingya teenager.
Bail is being processed now and the boy will be released today, he confirmed.
The 15-year-old was first charged under Section 6(1) of the Immigration Act for not having any valid travel documents in the vicinity of the Dato' Abu Bakar Baginda police station in Sepang district on Dec 11 last year.
The Sepang Magistrate's Court on Feb 28 had denied the teenager's application for bail.
His family then filed an application at the Shah Alam High Court, that the boy's detention since Dec 11 be set aside, quashed or stayed as it was in contravention of the Child Act 2001 and Article 22 of Child Rights Convention, which protects refugees seeking asylum from being prosecuted.
