The hearing of an appeal by a man convicted of voluntarily causing grievous hurt to national boxer Muhammad Farkhan Mohd Haron five years ago has been adjourned to July 13.

This came after the Court of Appeal ordered Tunku Nick Tazuddin Izwan Syah Tunku Qadir to file his petition of appeal within 14 days from today.

The order was made by Justice Mohd Zawawi Mohd Salleh, who led the three-member bench, after DPP Kwan Li Sa informed the court that Tunku Nick Tazuddin's newly appointed lawyer had failed to do so.

Following this, Justice Zawawi instructed his co-lawyer to file the relevant documents.

Earlier, co-counsel R Subash informed the bench that they have not obtained the records of appeal, and Justice Zawawi instructed them to collect the records at the High Court.

Subash also informed the court that lead counsel Mohd Daud Ismail is suffering from viral fever and hence the appeal hearing scheduled today cannot proceed.

Justice Zawawi noted that Daud had previously written in to ask for an adjournment of today's proceeding but this was not allowed by the court, and this led to the medical leave which he applied today.

Following this, the bench fixed May 26 for case management and a hearing date of the appeal on July 13.

The other two judges on the bench were Justice Idrus Harun and Justice Kamardin Hashim.

Tunku Nik, 32, was sentenced with two others to four years' jail each by the Johor Baru Sessions Court on June 28, 2013, after they were found guilty of jointly committing the offence at Jalan Molek 3/2, Taman Molek, Johor Baru, between 4.30am and 7am on May 6, 2012.

His sentence was upheld by the High Court prompting the latest appeal. As for the other two accused, one had already passed away while another is facing remand for another offence (murder).
