The court has fixed a date for Khairuddin Abu Hassan’s lawsuit against Prime Minister Najib Abdul Razak and his deputy Ahmad Zahid Hamidi for violating their oath of office, just one day after it was filed.

Khairuddin's lawyer Syed Iskandar Syed Jaffar Al Mahdzar told Malaysiakini that the Kuala Lumpur High Court fixed case management for Oct 12.

The public interest lawsuit accuses both Najib and Zahid of knowingly misleading the public on the origin of the US$681 million (RM2.6 billion) in Najib's personal bank account.

Khairuddin, a former Umno member, wants the court to declare that in misleading the public, Najib and Zahid violated their oaths under the Sixth Schedule of the Federal Constitution – meaning that both would be unfit to hold public office.

“Upon taking their oaths, they became trustees of their offices under public law and under a duty not to misrepresent the facts or to mislead Malaysians or lie to them on material issues,” he said in his statement of claim.

The statement alleges that sometime in March 2013, a sum of US$681 million from 1MDB was deposited into Najib's accounts, despite the prime minister’s repeated claims of the money coming from an Arab donor.

Khairuddin claims that the money came instead from Tanore Corporation Finance, a company controlled by Low Thaek Jho, who he claimed was Najib's agent.

Zahid’s involvement in the suit, meanwhile, is due to telling the Dewan Rakyat in 2015 that he had met with the Arab donor or donors in question – which Khairuddin insists is false, and therefore a violation of the deputy prime minister’s oath as a public officer.
