The High Court in Kuala Lumpur has fixed Nov 23 to deliver its decision on Prime Minister Najib Abdul Razak, 1MDB, Riza Aziz, and the government's application to strike out a suit brought on by Zaid Ibrahim regarding 1MDB.

Judicial commissioner Rohani Ismail fixed the date in chambers today following case management.

Rohani fixed Oct 23 for parties to file their written submission and Nov 3 for reply of the submission.

"Following that the court fixed Nov 23 for the decision," said Najib's lawyer Mohd Hafarizam Harun.

Also present were senior lawyer and former Federal Court judge Gopal Sri Ram.

Hafarizam said Zaid (photo) has no locus standii (legal standing) to initiate the class action and there is no reasonable cause of action for the former de facto law minister to initiate the suit.

Zaid filed the representative action suit against Najib, his stepson Riza Aziz, 1MDB and the government for breach of fiduciary duty.

The suit requested that the US$731 million deposited into Najib’s bank accounts be returned to the government, along with RM42 million received from 1MDB subsidiary SRC International Sdn Bhd.

Besides this, Zaid also filed a separate application with Ambank Islamic to have details of Najib's accounts.

It was reported that Najib, who was granted as an intervener in the application had also filed an application to strike out Zaid's application to have the data of the bank accounts, citing that the former Law Minister does not have the right to access his accounts.

Najib cited Section 145 of the Islamic Financial Services Act 2013 (Ifsa) in his application, which prohibits details regarding the transaction to accounts held in Islamic financial institutions cannot be revealed.​​​​​​​​​​​​​​
