The High Court in Kuala Lumpur has fixed Nov 27 to hear Petaling Jaya Utara MP Tony Pua's application to strike out a defamation suit filed by Prime Minister Najib Abdul Razak.

Justice Ahmad Zaidee Ibrahim also fixed hearing dates for five days beginning March 5, should the striking out fail.

The dates were fixed following case management today in his chambers.

Pua is seeking to strike out the suit, saying Najib had filed it in his personal capacity as the prime minister.

This is the first suit filed by Najib against Pua, as well as Media Rakyat owner Chan Chee Kong. Pua was said to have accused the premier, who was the chairperson of the 1MDB advisory board, of stealing the people's money in a speech at a dinner in Petaling Jaya.

Najib filed the suit two years ago, claiming Pua's words had meant that he (Najib) was unfit and untrustworthy to hold public office. 

The PM also stated in his statement of claim that the video, which was uploaded on YouTube, had close to 195,000 views as of March 2, 2015.

Najib further claimed that Chan had practiced irresponsible journalism and that such slander had extensively damaged his reputation.

The PM is seeking exemplary, aggravated and general damages. He is also seeking an injunction to stop the defendants from repeating and publishing the slanderous and libellous statements.

Besides this suit, Najib had also filed a suit against Pua earlier this year, over his comments on Facebook Live which claimed the tabling of the Syariah Court (Criminal Jurisdiction) Act 1965 (Act 355) was to divert public attention from 1MDB.

Pua also filed a class action misfeasance in public office suit against Najib following the losses made by 1MDB. However, as reported on Friday, Kuala Lumpur High Court judicial commissioner Faizah Jamaludin allowed Najib and the government to strike out the application.
