Landslide: Police report lodged on 'professional negligence'
A police report has been lodged on the deadly landslide in Tanjung Bungah, Penang, so that investigations into possible “professional negligence” by the developer can commence as soon as possible.
The move is in line with Section 304 (A) and (B) of the Penal Code, state executive councillor Chow Kon Yeow announced today.
Chow said the state government instructed the Penang Island City Council to lodge the report and urged all state agencies to cooperate with the police to complete the investigation soon.
“This is to ensure that anyone found to have committed the offence will shoulder the responsibility under the law,” Chow said at a press conference in Komtar today...

“This is to ensure that anyone found to have committed the offence will shoulder the responsibility under the law,” Chow said at a press conference in Komtar today.
“The purpose of the police report is to ensure that the police can charge anybody found to have committed professional negligence in carrying out his (or her) duties leading to the accident that killed 11 workers at the site,” he added.
The “worksite accident”, as described by Chief Minister Lim Guan Eng, occurred last Saturday, killing 11 - one Malaysian and 10 foreign workers.
It occurred at the site earmarked for 980 units of affordable housing and is being developed by Taman Sri Bunga Sdn Bhd, which is part of the Boon Siew Group.
Lim has vowed to investigate the incident thoroughly by forming a full State Commission of Inquiry, which will report to the Penang governor.
A stop work order has been issued to the developer and the contractor of the project has been blacklisted pending the investigations.
