The Court of Appeal today fixed Feb 19 to hear Anwar Ibrahim's application to strike out Youth and Sports Minister Khairy Jamaluddin Abu Bakar's notice of appeal on a defamation suit that the former opposition leader had won.

Together with this, the court will also hear the application from Khairy, who is also Umno Youth chief, to add more documents to his statement of appeal.

The date was fixed following case management at the Court of Appeal registry today.

This was confirmed to Malaysiakini by Anwar's counsel J Leela.

Khairy is said to want to add documents related to an article by former senator S Nallakaruppan, and on the Kajang Move, as part of his records of appeal. These documents were not used during the defamation trial.

Two months ago, the High Court ordered Khairy to pay RM150,000 in general damages and another RM60,000 as costs to Anwar after it found Khairy's remark at a ceramah in Lembah Pantai in 2008, prior to the 2008 general election, to be defamatory.

However, Justice Azizul Azmi Adnan did not award aggravated damages as he ruled that there was no malice in Khairy's statement.

“I am of the view that the words uttered by the defendant (Khairy) are defamatory of the plaintiff, within the reasonable and ordinary meaning to members of the public.

“The general damages to be charged is four percent interest from Feb 19, 2008, the date of the incident,” Justice Azizul said.

Anwar filed an RM100 million suit against Khairy, who was then Umno Youth deputy chief, for making the defamatory remarks at the ceramah he held in the Lembah Pantai constituency in 2008.
