DAP's Segambut MP Lim Lip Eng has made an application to strike out a defamation suit by MCA, following his allegation that the party had "pocketed" government funds meant for Chinese vernacular school.

His lawyer Guok Ngek Seong told the High Court in Kuala Lumpur that a political party cannot file a suit against Lim.

Citing a case law from the United Kingdom, the lawyer argued that political parties can't sue an individual.

"There are no Malaysian cases. As we argued that this is the position in the United Kingdom, it applies here too," added Geok.

Justice Ahmad Zaidi Ibrahim then fixed Feb 27 to deliver his decision on the striking-out application.

The MCA was represented by lawyer Ng Choo Ho.

The MCA filed the defamation suit against Lim through its secretary-general Ong Ka Chuan.

This came after the party sent a letter of demand to the DAP lawmaker to pay damages and retract his statement within seven days.
