Court fixes May 10 to decide on MCMC and Nuemera striking out

The Sessions Court in Kuala Lumpur will decide on May 10 on the striking out applications by Malaysian Communications and Multimedia Commission and company Nuemera Sdn Bhd over a suit filed by PKR communication director Fahmi Fadzil regarding the breach of 46.2 million telecommunication users' data.
The date was fixed following case management today before Harmi Thamri Mohamad.
According to Fahmi, the case has also been transferred to the KL Sessions Court Civil (Cyber court).
It was reported on Thursday that MCMC sought to strike out the suit after it filed the defence and cited Section 272 of the Communications and Multimedia Act 1998 where it stated it and its officers are immune of any legal action.
Nuemera questioned Fahmi's legal standing in instituting the action, saying action should have been taken by a telecommunication company.
The leak was widely reported by the media in October 2017, after an attempt by an unknown user to sell the data in popular technology portal Lowyat.net.
In his originating summons, Fahmi said his personal particulars were found to have been leaked and could be accessed on several websites.
The politician claimed that MCMC and Nuemera had violated their duties, resulting in the data leak and failure to ensure the security of personal details.
He also claimed the defendants had failed to inform him and other customers of the leak, or of Nuemera’s appointment and its alleged mismanagement of customers’ data.
Therefore, he is seeking general damages and costs of the action, besides other reliefs deemed necessary by the court.
