GE14 | The four office bearers of Bersatu have yet to receive the notice of temporary dissolution by the Registrar of Societies (ROS), under Section 14(5) of the Societies Act 1966.

Bersatu lawyer Rosli Dahlan said under Section 62 of the Act, such notice must be served to the four office bearers and not to anyone else.

"As off 10.45am today, the office bearers from the president, secretary-general, organising secretary and treasurer have yet to receive the notice, " he told reporters after the matter was brought up before Kuala Lumpur High Court Justice Kamaludin Md Said.

As such, he said Justice Kamaludin has fixed tomorrow to hear the leave application.

Senior federal counsel Suzana Atan appeared for the Attorney-General’s Chambers representing ROS director-general Surayati Ibrahim.

Bersatu secretary-general Shaharudin Md Salleh had on Thursday filed a judicial review application against Surayati for declaring the provisional dissolution of the party co-founded by Dr Mahathir Mohamad.

Bersatu is seeking a declaration from the court that the party had complied with Section 14(2) of the Societies Act and that it can contest in the 14th general election as a valid political party.

It is also seeking a prohibition order against Surayati for wrongly issuing the order of dissolution to Bersatu by abusing the provisions stipulated in Section 14(5) of the same Act.

Section 14(2) states that the Registrar can, at any time, order any registered society to furnish him, in writing, various documents including; rules of the society, a complete list of its office bearers of any branch, or such other information necessary.

Section 14(5) states that where the particulars required under subsection (2) are not furnished within the time stated in the order, or any extension thereof allowed by the ROS, the latter may make a provisional order for dissolution of the society.

Meanwhile, in another courtroom, High Court judge S Nantha Balan allowed Bersatu's application to withdraw its suit against the ROS filed last February, claiming ROS neglected its duty.

Lawyer Mohd Haniff Khatri Abdulla said the application was withdrawn following the separate application filed last Friday.
