Police corporal acquitted over 'false PM, DPM' post

The Kuala Lumpur Sessions Court today acquitted a 40-year-old police corporal on a charge that he posted an offensive and false comment on caretaker prime minister Najib Abdul Razak and his deputy Ahmad Zahid Hamidi online.

Sessions judge Zaman Mohd Noor ruled that prosecution had failed to prove a prima facie case against Nik Azmi Nik Mustapha who was accused by Kelab Suara Umno of posting the comment on his Facebook page last year.

However, Zaman cited gaps in the prosecution's case whereby they had failed to call in any witnesses from the club to verify what had been posted.

"The prosecution also failed to prove the element how such posting is offensive as per the charge sheet. The forensic report did not report any information connected to the case.

"After listening to the testimonies of the witnesses, the court found there is no prima facie case against the person who is being summoned (Nik Azmi), and hence, the court acquits and discharges him without the need to call for defence," the judge said.

In all, four prosecution witnesses testified in the case which began on March 21.

Nik Azmi had been stationed at the Sentul district police station but was suspended.

He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998 for posting the offensive and false comment on his Facebook page at midnight on Dec 12, 2016.

The charge carries a maximum fine of RM50,000 upon conviction.

Nik Azmi was represented by lawyer Zulhazmi Sharif while DPP Noor Jazilah Mohd Yushaa prosecuted.
