With the 1MDB audit report having been declassified by the National Audit Department on Tuesday, former senator Ezam Mohd Noor (above) said he plans to use it in his appeal.

This for his pending appeal to the Court of Appeal over the Kuala Lumpur High Court's decision to strike out his class action against ex-prime minister Najib Abdul Razak, 1MDB and its present and past directors over the purported losses of US$3.66 billion involving the controversial state-owned fund.

"My lawyers and I have gone through both the declassified 1MDB audit report and the Public Accounts Committee report. We plan to submit to the court a fresh application to include these reports in my appeal.

"I hope my lawyers can make the proper filing next week," he told Malaysiakini.

It was reported on May 7 that Ezam had filed a notice of appeal over the April 9 High Court's decision by Justice Nik Hasmat Nik Mohamed who allowed Najib and 1MDB's application to strike out Ezam's suit on the grounds that he did not have the legal standing to initiate the suit representing all Malaysians.

Justice Nik Hasmat ordered Ezam to pay a total of RM63,000 in costs.

Previously, it was reported that Ezam was also unsuccessful include Singapore court documents regarding 1MDB-linked proceedings and had filed an appeal over the decision.

In his suit, Ezam claimed that Najib, nine former 1MDB directors, five present directors and the Malaysian government had breached their fiduciary duties accusing them of intentionally causing “wrongful losses” of US$3.66 billion for 1MDB.

The US$3.66 billion total sum claimed by Ezam came from US$1.03 billion transferred to Good Star Ltd and used for a joint venture with PetroSaudi International Ltd, a US$1.367 billion paid to Aabar BVI and a US$1.26 billion paid to Tanore Finance Corporation.

He said he filed the suit in his personal capacity as a taxpayer to represent all Malaysians and pledged to return the damages back to the 1MDB and the government should the court rule in his favour.

Yesterday, premier Dr Mahathir Mohamad had said the scale of alleged wrongdoing in 1MDB is greater than what the public knew.
