‘I saw something burning in the oil palm plantation’

The sixth accused in the murder trial of deputy public prosecutor Anthony Kevin Morais told the High Court in Kuala Lumpur yesterday that he was taken to an oil palm plantation in Hutan Melintang, a few days before Kevin Morais' car was found torched in the area.

S Nimalan, 25, said he had gone to the plantation with G Gunasekaran, or 'Jay', and seventh accused S Ravi Chandaran, who is his uncle.

Nimalan, who was driving a Mitsubishi, was following a Proton Perdana V6 driven by Ravi Chandaran, and also in the car was Gunasekaran.

"After a long journey (from Subang Jaya), they entered an oil palm plantation. After a while, Ravi stopped and I stopped my vehicle behind him.

"Then Jay got out of the vehicle, came towards mine and told me to wait there," he said during the examination-in-chief by counsel V Rajehgopal on the 11th day of the defence trial.

Nimalan said Jay then re-entered the Proton Perdana which was driven deep into the plantation, and after about 20 minutes later, he saw Jay and Ravi Chandaran walk towards his vehicle.

"They got into the Triton. I asked them where was the car (Proton Perdana), at that time, I saw something burning from a distance. I asked Jay what happened, Jay said: "(You) don’t have to know, only me and Ravi need to know," said Nimalan, adding that Jay then told him to drive the Triton out of the plantation.

To Rajehgopal’s question on what was time, Nimalan said he was not sure but it was dark and the area was only lit by moonlight.

Rajehgopal is representing R Dinishwaran, 26, AK Thinesh Kumar, 25, M Vishwanath, 28, Nimalan and Ravi Chandaran, 47. Another accused, military doctor, Dr R Kunaseegaran, 55, was represented by counsel N Sivananthan.

Deputy public prosecutor Saiful Edris Zainuddin led the prosecution team.

Dinishwaran, Thinesh Kumar, Vishwanath; Nimalan, Ravi Chandaran, and Dr Kunaseegaran are accused of murdering Kevin Morais along Jalan Dutamas 1, Sentul to No.1 Jalan USJ 1/6D, Subang Jaya, between 7am and 8pm on Sept 4, 2015.

They face the mandatory death sentence if found guilty, under Section 302 read with Section 34 of the Penal Code.

Gunasekaran, who was the second accused is now free after serving two years in prison. He changed his plea to guilty after being charged with concealing Kevin Morais’ body and destroying his vehicle.

Kevin Morais’ body was found inside a drum filled with concrete at Persiaran Subang Mewah, Subang Jaya near here, on Sept 16, 2015. He was reported missing on Sept 4, 2015.

The trial before justice Azman Abdullah continues on June 6.
