The prosecution should immediately file an appeal to the Court of Appeal to revoke the bail granted by the Shah Alam High Court yesterday to Sungai Besar Umno division chief Jamal Md Yunos.

Lawyer Baljit Singh Sidhu said a certificate of urgency should be filed for the matter to be heard immediately.

He cited the special circumstances to revoke bail was the fact that Jamal had previously fled the country.

"The court has the inherent jurisdiction to refuse in granting bail although the offence is bailable under Section 387 of the Criminal Procedure Code.

"Here Jamal had run away and fled from the country when bail was granted after he was charged. There is enough evidence for the prosecution to apply for that bail to be revoked as he had run away and we had to spend money to bring him back from Indonesia," he said.

What is the guarantee, the lawyer asked, that Jamal would not do it again?

Baljit, who is also a member of Bar Council's criminal law committee, was asked to comment on Jamal being granted bail of RM20,000 by the Shah Alam High Court on the grounds that magistrate's court does not have the power to revoke bail.

Another lawyer Syed Iskandar Syed Jaafar Al Mahdzar, also agreed that the bail should be revoked as Jamal had fled abroad.

"He ran to Indonesia, and did not use his passport. This shows he may have had assistance in running away. Therefore, bail should be revoked," he said, adding that an appeal should be lodged with the Court of Appeal.

It was reported that Jamal and four others are facing two charges under Section 448 of the Penal Code for trespassing into two business premises at Taman Kosas, Ampang on Dec 29, 2016.

Section 448 of the Penal Code carries a maximum jail sentence of three years, an RM5,000 fine, or both.

Jamal is also facing a charge under Section 224 of the Penal Code for escaping police custody.

Baljit said although the High Court may be right to intervene, the prosecution can appeal the matter to the Court of Appeal and this should be done immediately.

He also urged the police and court authorities to review the bail procedure to ensure this episode does not recur.

Jamal was said to have left the Ampang Hospital before the bail process was completed.

Despite saying he would surrender, he did not do so and instead fled to Indonesia. He was arrested by Indonesian authorities last month and deported back to Malaysia.
