The cabinet has agreed to establish a Royal Commission of Inquiry (RCI) on the judiciary, according to high-level government sources.
Malaysiakini understands that Prime Minister Dr Mahathir Mohamad would issue a statement on the matter soon.
The sources, whom Malaysiakini contacted, declined to be named or reveal more details regarding the RCI.
“Yes. The PM will announce,” said one of the sources when quizzed.
Last week, Court of Appeal judge Hamid Sultan Abu Backer said an RCI was pertinent to address the alleged multiple instances of judicial misconduct.
In a shocking affidavit, Hamid made several allegations of interference and even detailed a scam involving politicians, the private sector and judges to swindle public funds.
The senior judge said he is willing to reveal more if an RCI is formed, but expressed regret that Chief Justice Richard Malanjum is not keen on this.
His affidavit was filed in support of lawyer Sangeet Kaur Deo's application to declare that the chief justice failed to defend the integrity and credibility of the judiciary over two alleged incidents of judicial interference.
Multiple parties, including the Bar Council, have supported the call for the RCI.
RCIs are formed by the Yang di-Pertuan Agong in accordance with the Commissions of Enquiry Act.
Think they better do it pronto. Any delay will cost PH votes in GE15. We have waited long enough. i am sure. ( months of 'buta gaji' and still nothing happening. None found guilty and the thieves are still roaming including speaking at election 'ceremahs'
It is good news. However ,there should not be any "term and condition" ,or the clauses that limit the scope of investigation and the power of RCI,like in the past.
Since the AG’s chambers is accused of colluding with politicians by Court of Appeal Judge Hamid Sultan the current AG must appoint an independent panel of younger ( but not so young lawyers) to prepare the terms of reference, so difficult to prepare for such a gigantic exercise. They must be paid proper some reasonable remuneration for that.
