The Kuala Lumpur High Court hearing of the civil suit brought up by odd job worker Suzana Md Aris, 37, widow of a police detainee who died while in custody in 1999, entered its second day today.

In her writ of summons, Suzana, wife of Anuar Sarip who died under police custody six years ago, named then Gombak police chief Ishak Hussain, then Gombak district CID chief Massari Hashim, then Inspector General of Police Norian Mai and the Malaysian government as defendants.

Suzana said in her written affidavit that she was informed of her husband's death while in police lockup eight days after his arrest through a note from the police.

Anuar was arrested on the night of Aug 10, 1999 for suspected drug offences and subsequently remanded for 14 days.

The deceased's younger brother, Omar, who testified as the plaintiff's witness told the court today that he had seen the deceased's body before and after the post mortem.

Bruises all over

Yesterday, the court heard from Omar that he found blood on the deceased's nose and witness various injuries including bruises on the deceased's groin, hip, chest and back.

He also told the court that two holes "as though pierced by three-inch nails" were found on both sides of the deceased's hips.

Under cross examination today, Omar disagreed that he had merely "looked" at the deceased's body as suggested by Senior Federal Counsel Amerjeet Singh.

To a question, Omar also disagreed that the two holes on the deceased's hips were made by medical equipment used during post mortem.

Counsel for the plaintiff, P Uthayakumar, closed his case today after calling four witnesses. The defense witnesses will testify beginning April 20.

Suzana is seeking more than RM500,000 in damages from the defendants. She has two sons aged 14 and eight.

The case was heard before Justice Kang Hwee Gee.
