Parti Keadilan Rakyat (PKR) secretary-general Kamarul Baharin Abbas is facing a bankruptcy notice for allegedly owing a company director over RM4 million.

However, Kamarul, 59, has filed an application to set aside the bankruptcy notice dated Jan 10 filed against him for failing to adhere to a court order to pay RM2.112 million to Mohamed Yusof Abu Othman.

According to Bernama , Senior Assistant Registrar Siti Shakirah Mohtarudin today fixed June 5 to hear Kamarul's application to set aside the bankruptcy notice after granting him a postponement.

The High Court on Sept 5, 2002, ordered Kamarul to pay RM2.112 million to Mohamed Yusof, 55, after allowing the latter's civil claim for payment for the sale of 844,800 shares of Tenaga Ehsan Sdn Bhd to Kamarul.

The sum has since increased to RM4,069,741.47 with accumulated interest.

'Tainted with malice'

Meanwhile, another new report stated that Kamarul said the notice should be set aside because it was "bad in law, excessive and unenforceable".

In an affidavit supporting the application, he said the court order had since been compromised as he had entered into an agreement with Mohd Yusof.

"The issuance of the said notice against me is clearly tainted with malice as it is designed and calculated to apply improper and unlawful pressure on me to settle the judgment debt," he was quoted as saying in his affidavit by the Star .

"I am further advised by my solicitors that this malicious institution of bankruptcy proceedings against me is tantamount to an abuse of power," he added.
