Elderly man in slapping case to be charged again this evening

An elderly man who was discharged earlier this morning from a case involving a slapping incident will be charged in court again this evening.

In a statement today, the Attorney-General’s Chambers said there was a “technical issue” with the charges filed against Abdul Razak Ismail this morning.

“The technical issue with the charge has been overcome and the individual concerned will be charged again at the Johor Bahru Magistrate’s Court on the evening of March 19,” it said.

The AGC assured it is committed to having justice upheld for all parties in accordance with the law.

DNAA

Razak was charged at the same court this morning over an incident on March 16 where he supposedly slapped a non-Muslim for eating at a convenience store in the daytime during Ramadan.

The charge framed under Section 323 of the Penal Code for voluntarily causing hurt provides a maximum one-year jail sentence or up to RM2,000 fine, or both.

Razak had pleaded guilty but then disputed the facts of the case. This caused Magistrate A Shaarmini to order the 65-year-old to appoint a lawyer to defend himself.

The prosecution then informed the court it had received instructions to refer the case to the AGC.

The court thus ordered a discharge not amounting to acquittal (DNAA).
