Lawyer and Hindraf leader R Kengadharan today filed an application at the Kuala Lumpur High Court seeking his release from detention under the Internal Security Act (ISA).

The writ of habeas corpus was filed by lawyer Gobind Singh Deo at the court registry at about 11am.

With the filing of Kengadharan’s application today, all five Hindraf leaders detained under the ISA have now filed the writ of habeas corpus to seek their release.

The other four — lawyers P Utayakumar, 46, M Manoharan, 46, V Ganabatirau, 34, and former bank officer K Vasantha Kumar, 34, had filed similar applications last week.

The court will hear all their applications on Wednesday .

Vague detention order

In his application today, Kengadharan named the Internal Security Minister as first respondent and the Taiping Detention Camp superintendent as second respondent.

Kengadharan, 40, in his affidavit, said the grounds for his detention were vague and not clear as the detention order did not clearly mention whether he was involved in a plan to seek the support of the Liberation Tigers of Tamil Eelam (LTTE).

He claimed that the police intention linking him with LTTE was done in bad faith and he denied any involvement with the terrorist movement based in Sri Lanka.

Kengadharan was arrested under the ISA with the four others on Dec 13 for their alleged involvement in organising illegal gatherings on Nov 25 and making seditious statements against the government.

The five are the prime movers of the Hindu Rights Action Force.

Habeas corpus is a writ ordering prisoners to be brought before a court or judge to ascertain if there are any procedural defects which could render their detention unlawful.
