The Shah Alam High Court has dismissed Zayn Rayyan Abdul Matin’s mother, Ismanira Abdul Manaf's, application to stay her five-year jail sentence this morning.

Judge Aslam Zainuddin ruled that there were no special circumstances to grant her a stay.

One of Ismanira’s lawyers, Tiara Katrina Fuad, confirmed to Malaysiakini after the proceeding that they will file an appeal against the verdict.

The lawyer also added that as of now, there was no date fixed to hear Ismanira’s appeal against her guilty conviction.

The 30-year-old started her jail sentence on Oct 31, following the Petaling Jaya Sessions Court’s finding her guilty of neglecting Zayn, her six-year-old autistic son, who was found dead in 2023.

The court also denied her application to postpone her jail sentence pending her substantive appeal against the conviction.

Judge Syahliza Warnoh, at the time, cited a similar reason in dismissing her application for a stay of her jail sentence, stating that there were no special circumstances to warrant a postponement.

Ismanira was charged on June 31 last year under Section 31(1)(a) of the Child Act 2001 with neglecting Zayn from Dec 5 to 6 in 2023, to the point that it may cause him physical harm.

Her defence failed to raise a reasonable doubt against the prosecution’s case, and she was found guilty of negligence by allowing Zayn to walk behind her without supervision, which led to his disappearance.

Ismanira was initially charged alongside her husband, Zaim Ikhwan Zahari. However, Zaim was discharged without having to enter his defence after the prosecution determined there was insufficient evidence to proceed against him.

Zayn went missing on Dec 5, 2023, and was found dead near a stream at his house the next day, with injuries found on his neck and body. A post-mortem on his remains showed that he was murdered.
