Petaling Jaya Utara MP Tony Pua's application to strike out the defamation suit filed by Prime Minister Najib Abdul Razak in relation to the 1MDB issue will be heard on Nov 2.

On that same day, Najib's application to expunge certain portions of Pua's affidavit will also be heard.

The matter came up for case management today before Kuala Lumpur High Court judge Vazeer Alam Mydin Meera who sought to vacate the hearing dates that was earlier set on Sept 25, as he would be on leave.

Justice Vazeer also set Dec 1 to hear Najib's application to strike out certain portions of Media Rakyat.net owner's statement of defence.

The development today was confirmed by lawyer Aliff Benjamin Suhaimi who appeared for Pua. Lawyer Choo Shi Jin appeared for the prime minister while Shahid Adli Kamaruddin represented Chan.

The prime minister filed a suit against Pua ( photo ), who is also DAP national publicity secretary, on Nov 13 last year, following a speech the federal lawmaker made at a DAP fund-raising dinner.

A recording of the speech was uploaded by Media Rakyat.net owner Chan Chee Kong.

Najib's suit is the first filed against a federal lawmaker by a sitting prime minister.

He claims that Pua's speech and the video recording implied that he had stolen or is going to continue to steal the people's money with regards to the 1MDB project.

He said it also meant that the prime minister, as chairperson of 1MDB's advisory board, had abused his powers for personal gain and hence had betrayed the public.

Aggravated and general dmages

Najib further alleged the speech made by Pua also meant that he is not trustworthy and unfit to hold public office.

Pua's speech was put up on news portal Media Rakyat with the title 'Tony Pua: Najib is creating the biggest scandal ever in the history of Malaysia'. The video had more than 200,000 views.

Najib is seeking exemplary, aggravated and general damages. He is also seeking an injunction to stop the defendants from repeating and publishing what he alleged were 'slanderous' and 'libellous' statements.

Besides Pua, Najib had also filed separate suits against PAS organ Harakah , PKR vice-president Rafizi Ramli and DAP's Taiping MP Nga Kor Ming and also Malaysiakini .
