The lawyer representing Umno Langkawi member Anina Saadudin who filed a suit against party president Najib Abdul Razak said they will do their talking in court, following threats of her expulsion.

Hanif Khatri Abdullah ( photo ) said God-willing, they will be ready to argue the matters from all angles.

“Whatever action (to counter the threat of expulsion) we will do it in court. We are ready to face any eventuality,” he said when contacted by Malaysiakini .

Anina had on Friday filed a suit through Hanif's lawfirm to seek a chunk of the RM2.6 billion alleged party donations which was deposited into Najib's personal accounts.

The US$650 million is said to be the balance from the original US$681 million (RM2.6 billion) the prime minister had received as donations.

The transfer of the US$650 million to Singapore, happened sometime in Aug 30, 2013, the same day Najib closed the account.

Besides naming Najib, Anina also named Umno's organising secretary, Abdul Rauf Yusoh as the other defendant.

Hanif was asked to comment on Umno lawyer Mohd Hafarizam Harun's statement that Anina will be kicked out of Umno as soon as Najib receives the suit.

According to Sin Chew Daily , the Umno office will issue a notice to Anina to revoke her membership.

Hafarizam ( photo ) had said that under the Registrar of Societies Act 1966, the courts do not have the power to try or decide on party matters and as such, Anina will still likely lose her membership.

However, in one of Anina's prayers in the suit, she sought an injunction against Najib and Abdul Rauf or their agents in the disciplinary board, state liaison body, divisions, and branches to be restrained from removing, suspending, and taking disciplinary action on her, pending the disposal of this action.

Hence, this injunction application will have to be heard first before the suit.

Case management on Sept 21

Hanif told Malaysiakini that Anina's lawyers will serve the documents to Najib and Abdul Rauf, and hoped there won't be any hindrance.

In fact, he said they could inform them their lawyers on record as this would facilitate them to serve the documents.

Hanif said he does not know which judge has been assigned to hear the case.

“However, a case management date has been fixed on Sept 21 before a deputy registrar. Probably we will know by then.

“The date was given after the extraction of the suit was made,” he said.

It was reported that Anina ( photo ) was also seeking details of all monies in the AmPrivate Banking Account No 2112022009694 allegedly belonging to Najib, along with damages, costs, and other reliefs.

The complainant further argued in the claim that the monies said to have been donation from a Middle Eastern source for the party's benefit allegedly did not appear in the party's audited accounts.

The sum of RM2.6 billion allegedly did not appear in Umno's audited accounts for the financial years 2013 and 2014, as stated in Anina's statement of claim.

Former premier Dr Mahathir Mohamad had on Saturday praised Anina's brave effort in suing Najib, where he said in business, if there's no risk, there is no gain. If you want to be safe, don't do it and that is why he wanted to congratulate Anina for being brave.
