Amid the dispute over Wisma Tok Guru in Kelantan, four Amanah members have succeeded in striking out an application by PAS and its Batu division chief Azhar Yahya to be parties in a legal tussle over a Kuala Lumpur property.

The property in question was once used by Batu PAS division, but its usage came into question after some Batu PAS office bearers left for Amanah.

The High Court in Kuala Lumpur today ruled that Md Mansor Ali, the plaintiff, was the trustee and owner of the said property.

Justice Ahmad Zaidi Ibrahim ruled that Azhar (photo) and PAS do not have the locus standi to be parties in the suit. They were ordered to pay RM3,000 in costs to the four defendants.

Case management on the matter has been set for Jan 24.

Mansor is suing Rosden Mohd Yassin, M Suhaimi A Rahaman, Ismail Yahaya and Jamhor Nawawi to invalidate the power of attorney over the property given to the four defendants on Aug 18, 2015.

Mansor is also seeking a declaration that would grant PAS ownership of the property.

According to Mansor's statement of claim, the property was acquired for RM250,000 in 2001. The deposit and other expenses for the property were paid by the party, he said.

The four defendants, Mansor said, were PAS committee members for the 2013-2015 term and were among the trustees of the said property.

However, the four defendants relinquished their positions on March 16, 2015, as they were among a group of PAS members who left the Islamic party to form Amanah.

Mansor told the court that sometime in November 2014, PAS received a notice from Bank Islam regarding arrears in loan repayment.

The defendants had paid RM15,000 each to settle the RM57,766 in arrears between end-2014 or early-2015.

According to court filings by Mansor and PAS, the four had resigned as Batu PAS committee members on March 16, 2015, and as such they had no right to make decisions on behalf of the party over said property.

Mansor and PAS also claimed that the four misrepresented themselves sometime in April 2015 with regard to the handling of the property, resulting in the power of attorney being issued on the defendants.

In May 2015, Batu PAS division held an extraordinary general meeting, where it was resolved that they would acquire the property and that defendants would be reimbursed if necessary.

The suit filed by Mansor is one of several ongoing court cases over property rights between PAS and Amanah members in several parts of the country.
