Najib and Arul expected to be charged on Wednesday

Najib Abdul Razak and Arul Kanda Kandasamy are expected to be charged at the Kuala Lumpur Sessions Court on Wednesday for alleged abuse of power in relation to the alleged tampering of the 1MDB audit report.

MACC sources confirmed with Malaysiakini that the former premier and former 1MDB president will face one charge each.

According to Free Malaysia Today, Najib will be prosecuted under Section 23 of the MACC Act 2009 for using his office for gratification.

“He is said to have used his position by instructing the auditor-general to remove certain findings from the report, to evade any possible civil or criminal action in the future,” a source told FMT.

Arul Kanda, meanwhile, will be charged with abetting Najib.

A highly placed source within the MACC also confirmed with Malaysiakini that both Najib and Arul Kanda will be called to the MACC headquarters tomorrow before being charged the following day.

Although the charge is under Section 23, the punishment under Section 24 of the same act accords a punishment of 20 years' jail and a fine of RM10,000 or five times the amount of gratification.

Malaysiakini reported on Dec 5 that the duo could be charged in relation to the 1MDB audit report tampering under Section 23.

Najib was also called to the MACC on Dec 6 to have his statement recorded regarding the audit report.

Najib was arrested at the MACC headquarters under Section 23 of the MACC Act this morning, but is expected to be released later today.

Earlier, he accompanied his wife Rosmah Mansor to the Jalan Duta court complex for case management of the two charges she is facing in relation to the solar hybrid project in Sarawak.
