14-year-old charged with murder over Bandar Utama stabbing

A 14-year-old boy has been charged with murder over the fatal stabbing of a 16-year-old schoolmate in Bandar Utama on Oct 14.

The charge under Section 302 of the Penal Code was read out behind closed doors at the Magistrate's Court in Petaling Jaya today.

However, the media reported that no plea was entered as the case is under the jurisdiction of the High Court.

The identity of the accused is withheld as this is a juvenile case.

Section 302 carries with it the death penalty or a jail term of between 30 years and 40 years, and 12 strokes of the cane.

Psychiatric evaluation

Magistrate Amira Sariaty Zainal granted the boy’s lawyer’s application for the accused to undergo a psychiatric evaluation, the New Straits Times reported.

Anwar Ezzad Zainal made the application citing Section 342 of the Criminal Procedure Code, which covers cases in which the accused is suspected to be of unsound mind.

Lawyer Kitson Foong, who appeared as a friend of the court, confirmed the matter to the English daily.

The victim, Yap Shing Xuen, was fatally stabbed at the girls’ toilet at her school in Bandar Utama, Selangor.

She was laid to rest on Monday.
