LETTER | I refer to the Malaysiakini news report on the setting up of a royal commission of inquiry (RCI) on the judiciary quoting Param Cumaraswamy. The learned ex-Bar Council president Param should be aware of the following:

Excerpts from Lord Neuberger of Abbotsbury in his lecture "Who are the masters, now?"(citation paragraph 73, Lord Alexander of Weedon lecture, April 6, 2011) mentioned that although the judges had a vital role to play in protecting individuals against the abuses and excess of an increasingly powerful executive, the judges could not go against the will of Parliament as expressed through a statue.

So, the learned Param in my humble opinion erred in his response of the cabinet setting up an RCI to investigate the judges after the revelation of Court of Appeal Judge Hamid Sultan Abu Backer's affidavit with regards to judicial misconduct of our current judicial bench.

The most important question now is who is going to judge the judges?
