The 59th PAS Muktamar has unanimously passed a resolution to urge the federal government to implement the Islamic penal code, including the controversial hudud law.

The motion, which was co-proposed by the Muslimat (women's) wing, also called for the required changes to the federal constitution to facilitate the implementation of the code.

Supporting the motion, Kedah delegate Abdul Ghani Ahmad also urged the PAS leadership to have a "heart-to-heart" discussion with Prime Minister Najib Abdul Razak on the matter.

'Whatever the PM says becomes law, like his speech on the Internal Security Act and then the Goods and Services Tax.

"Meet him on the basis of a heart-to-heart talk between Muslims to implement the syariah ," he said.

Be transparent about hudud

Also backing the motion was Klang delegate Mohd Prasadh Halim, who called on all PAS members to be united and transparent about PAS' intention to implement the Islamic code.

He said the PAS leadership should not be "wishy washy ( cakap berlapik )" and claim that hudud is not the priority now.

"Don't say let's focus on justice, and not speak of hudud or Islamic state. Cakap berlapik as if we have a hidden agenda. We don't," he said.

He said just like PAS should not be surprised by DAP chairperson Karpal Singh's decade-old stand on the Islamic state, PAS too should be steadfast about its own principles which has not changed since its inception.

"There's no need to turn it into a polemic. Let us be transparent about it... and educate people on this ideology that we bring," he said.

The Islamic penal code includes the hudud , takzir (discretionary), qisas (retribution) and diyya (compensation).

The hudud are crimes for which punishments are fixed by the Quran while takzir are offences which are not specified in the Quran.

The crimes for which punishments are set include apostasy, theft, illicit sex, making unproven accusations of illicit sex and intoxication.

However, the burden of proof is very high and would include eyewitnesses.
