Former Langkawi Umno member Anina Saadudin was granted a stay by the High Court in Kuala Lumpur today on Prime Minister Najib Abdul Razak's application to strike out her suit.

Judicial Commissioner Mohd Zaki Abdul Wahab said the court agreed with Anina's lawyer that there are special circumstances to grant a stay as this case is closely related to Anina's suit against Umno secretary-general Tengku Adnan Tengku Mansor and its executive secretary Abdul Rauf Yusoh.

"Hence I allow the stay and fix hearing for Dec 15, after the decision in the other court (on her suit against Umno for her sacking as a party member),” Mohd Zaki ruled.

Anina’s suit against Najib is on the RM2.6 billion donation that Najib admitted receiving in his personal bank accounts.

Tengku Adnan and Abdul Rauf's application to strike out her suit over her party membership status would be decided on Nov 30 before Judicial Commissioner S Nantha Balan.

Hanif submitted to Mohd Zaki two weeks ago that it would save the court's time by awaiting the decision on the application by Tengku Adnan and Abdul Rauf to strike out Anina's suit.

“If the application (by Tengku Adnan and Abdul Rauf) to strike out the suit fails, then this (Najib's) application to strike out will also fail.

“If the application by (Tengku Adnan and Abdul Rauf) to strike out succeeds, then it is not necessary that the application (by Najib) to strike out Anina's suit will also succeed,” Hanif said.

Besides the suit against Najib, Anina also sought a mareva injunction against the prime minister to freeze his assets that include Najib's house on Jalan Langgak Duta, Kuala Lumpur, and the balance of US$650 million of the donation in dispute.

Anina is also seeking that Najib declare the shares he owns, and also for him to within 10 days of the court order make a sworn affidavit listing his assets locally and also abroad, which he either individually or jointly owns.

A mareva injunction is an order sought in court to freeze assets so that a defendant in a legal action cannot dissipate the assets from beyond the jurisdiction of a court, so as to frustrate a judgment.
