Former Langkawi Umno member Anina Saadudin today filed a notice of appeal at the High Court in Kuala Lumpur against its decision to strike out her RM2.6 billion suit against Prime Minister and Umno president Najib Abdul Razak and Umno executive secretary Abdul Rauf Yusoh.

The notice was filed at the Kuala Lumpur High Court.

Her lawyer, Hanif Khatri, confirmed the filing was made at about noon today.

Anina filed her appeal over the decision of Judicial Commissioner Mohd Zaki Abdul Wahab who allowed Najib and Abdul Rauf's application to strike out the suit on Dec 31.

Zaki had ruled that Anina had no locus standii (legal standing) to file the suit because she had ceased being a party member when the suit was filed.

“Hence, her action is not sustainable and not maintainable,” the judicial commissioner ruled.

Anina filed the suit last Aug 28 to retrieve part of the RM2.6 billion which is said to be donation to Umno which was channelled into Najib's personal accounts, so that the funds entered into the party's accounts.

Today, attorney-general Mohamed Apandi Ali announced there would be no charges preferred against Najib based on the three investigation papers submitted by the Malaysian Anti-Corruption Commission. He also ordered the case closed.

Hanif also confirmed with Malaysiakini that his firm had filed a notice of appeal for the three NGOs appeal against Najib, International Trade and Industry Minister Mustapa Mohamed and the government to stop them from signing the controversial Trans-Pacific Partnership Agreement (TPPA).

This follows the decision of the Kuala Lumpur High Court Justice Hanipah Farikullah to dismiss the judicial review application to stop Najib and Mustapa from signing the TPPA.

"The agreement has not been signed yet and the matter is non-justiciable," she ruled in chambers.

Basically, non-justiciable means the matter is not capable of being determined by a court of law.

Abim, through its president Mohamad Raimi Ab Rahim, along with Nurfitri Amir Muhammad of Urusetia Menangani Gejala Sosial (Unggas) and Ahmad Tarmizi Sulaiman from Persatuan Pendidikan dan Kebajikan Melayu Malaysia (Teras), named Najib, Mustapa and the government as respondents.

All three are seeking an order to compel the respondents to present to them a copy of the TPPA, and other related documents, and a declaration from the court that signing the agreement will go against the Federal Constitution.
